By accessing or using Cernix ("we," "our," or "us") hospital management software and related services, you ("you" or "Client") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.
We provide hospital management software that processes healthcare data on your behalf. Our services include software access, maintenance, updates, and technical support as detailed in your service agreement.
You retain ownership of all healthcare data (including PHI) entered or uploaded into the system. We act as a data processor only and do not claim ownership of your data. Our handling of your data is governed by our Privacy Policy.
We implement industry-standard security measures to protect data; however, you acknowledge that no system is completely secure. You agree to notify us promptly of any security breaches or suspicious activity.
We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur. We will notify you in advance when possible.
To the maximum extent permitted by law:
Either party may terminate the service according to the terms of your agreement. Upon termination, we will retain your data only as long as required by applicable laws or as necessary to fulfill our contractual obligations. After that, your data will be securely deleted or returned to you, as agreed.
We may update these Terms from time to time. Continued use of the services constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws applicable to the provision of services by Cernix.
